Limitation of Liability

1. Important Notice (Read This)

This document explains important limits on our responsibility for any harm or loss arising from your use of The Adulting Calendar.

The Service provides informational schedules and reminders. It is not professional advice, is not a substitute for manufacturer guidance, building codes, safety standards, or common sense, and it does not provide real-time weather forecasts.

2. Historical Data and Weather/Climate Variability

Some event timing or recommendations may be generated using historical datasets (including, for example, historical frost date data) and simplified models or rules. These inputs are inherently uncertain and may not reflect current or future conditions.

Actual weather can be significantly different from historical averages. Conditions can vary from year to year and even block to block due to microclimates, elevation, proximity to water, urban heat effects, unusual storm systems, and long-term climate change. Because of this, a reminder that is “right” on average may be meaningfully wrong on a particular day or in a particular location.

You are responsible for independently verifying conditions (including current weather, forecasts, temperatures, freeze risk, precipitation, wind, and site conditions) before acting on any reminder.

3. Assumption of Risk

You understand and agree that performing maintenance tasks (including tasks related to winterization, plumbing, electrical systems, yard work, ladders/roof access, and power tools) involves inherent risks of property damage, bodily injury, and other loss. You assume all risks arising from your decisions, actions, and reliance on information provided by the Service.

4. No Liability for Decisions, Outcomes, or Third Parties

To the maximum extent permitted by law, we are not responsible for losses arising from:

  • Your reliance on any reminder date, recommendation, description, or schedule.
  • Weather variability, forecast error, incorrect or incomplete historical datasets, or model limitations.
  • Integration or syncing behavior of third-party calendar clients, email providers, networks, or devices (including delays, duplicate events, missing events, or display differences).
  • The actions or omissions of third parties, including contractors, manufacturers, payment processors, or service providers.

5. Disclaimer of Certain Damages

To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, data, or business interruption, even if we have been advised of the possibility of such damages.

6. Cap on Liability

To the maximum extent permitted by law, our total liability for any claim arising out of or related to the Service will not exceed the greater of (a) the amount you paid to us for the Service in the 12 months preceding the event giving rise to the claim, or (b) $100.

7. Basis of the Bargain

You acknowledge that these limitations of liability are a fundamental part of the agreement between you and us and that we would not provide the Service without them.

8. Relationship to the Terms of Service

This Limitation of Liability is incorporated by reference into our Terms of Service. If there is a conflict, the provisions that most strongly limit liability will apply to the extent permitted by law.

9. Exceptions Where Not Allowed

Some jurisdictions do not allow certain limitations of liability or exclusions of damages. In those jurisdictions, some of the above limitations may not apply to you, and our liability will be limited to the greatest extent permitted by law.
